The opinion of the court was delivered by This is a first impression annexation case construing certain
1987 amendments to K.S.A. 12-521. The City of Topeka (City)
challenges an order of the Board of Commissioners of Shawnee
County (Board) denying the City's petition to annex lands
adjacent to the southwest corner of Topeka (the Sherwood area).
The City appealed the Board's denial of the annexation petition
to the district court. The district court's affirmance of the
Board's order is now before us. The two issues are: (1) whether
the district court applied the proper standard of review, and (2)
whether there was substantial evidence to support the Board's
conclusion. Our jurisdiction is based on K.S.A. 20-3018(c) by
transfer under our own motion. The applicable standard of review requires us to first
determine whether the district court observed the requirements
placed upon it and then conduct a similar review of the Board's
action. In re Appeal of City of Lenexa, 232 Kan. 568, 576,
657 P.2d 47 (1983). The appropriate district court standard of review
is analyzed as an issue in the opinion.
